The firm BORMAN DUMA ZITHA ATTORNEYS was established on 18 January 2006 by partners, Nelson Borman, Abednego Duma, and Victor Zitha.  The aim was to provide legal services to private and public sectors as well as individuals. The firm is a multi-cultural firm which specializes in various areas of the law.  BORMAN DUMA ZITHA ATTORNEYS has established offices in Johannesburg and Pretoria which give it easy access to clients and their market.  Our firm promotes a unique culture and policies addressing issues such as affirmative action as well as black empowerment inter alia for purposes of ensuring skills transfer. Environmental Law and Occupational Health and Safety

Members of our team were involved in an environmental skills transfer project with Edward Nathan Sonnenbergs (ENS), where they reviewed Eskom’s environmental and health and safety legal registers. In particular, they reviewed and prepared both Kusile and Medupi’s health and safety registers for audit purposes. They also attended to various Eskom power stations reviewing their health and safety compliance with the Occupational Health and Safety Act. They were also involved in training on the legal register that was developed.

Constitutional Law and Restitution of Land Claims

Our Mr Zitha has constitutional law experience. He and other members of our team have been involved in matters like evictions and illegal evictions in terms of ESTA and PIE, Land Claims Court Matters, matters involving Community Property Associations, Labour Tenants and Farm Owners, restitution of land and other property related matters emanating from clients’ constitutional rights. This includes mediation services to the aforementioned parties. Our firm is currently on the panels of the Land and Rights Management Facility Panel of The Department of Rural Development and Land Reform as well as the Conveyancing Panel of the Commission on Restitution of Land Rights.

Personal Injury Law

Our Team has extensive experience in personal injury matters in the Magistrates’ Court and especially in the High Court. They are extremely experienced in court appearances, drafting of pleadings, notices and other legal documents. We have served on the panel of the Road Accident Fund for more than 5 years.

Labour and Employment Law, Conciliations and Arbitrations

Members of our firm have practical experience and knowledge in this field, acting in the CCMA and the Labour Courts. They also have knowledge of Bargaining Councils. Our firm is experienced with the initiation and chairing of disciplinary proceedings, and we have represented companies, state entities and individuals at the CCMA, Arbitrations, the Labour Court and Labour Appeals Court.

Conveyancing, Property Law and Notarial Practice

As far as these areas are concerned, we are in a position to render the required services, especially due to the fact that our Ms Alma Swanepoel has over the years acted on behalf of financial institutions, property developers, state owned companies and private clients. She is an admitted conveyancer and notary public. She has experience in transfers of fixed property; subdivisions and consolidations of fixed property; notarial bonds; mortgage bonds; notarial leases as well as notarial servitudes regarding gas pipelines or electrical power transmission lines, rights of way, etc. She also has experience in the opening of Township- and Sectional Title Registers and all matters pertaining thereto. She is also familiar with the drafting of all necessary contracts relating to all property matters and giving general advice in all aspects of property law. She also has experience with the execution and registration of Prospecting Rights. As stated, members of our firm have acted on the panel of attorneys of the company known as Servcon Housing Solutions. This company was a venture in which the South African Government and Banking Institutions co-operated as far as housing facilities for people coming from disadvantaged communities are concerned. We have also done transfers, subdivisions and expropriations for The South African National Roads Agency Limited (SANRAL), restitution transfers for the Commission on Restitution of Land Rights as well as transfers and servitude registrations, cancellations and route descriptions for Eskom Holdings SOC Limited. Our Mr Zitha acts on behalf on the City of Ekurhuleni and represents the City in bringing various High Court Applications involving the contravention of the applicable zoning of immovable properties and the contravention of various Municipal By-Laws of the City. He also represents the National Home Builders Registration Council (NHBRC) in various High Court Litigation Matters involving the contravention of legislation by property owners and builders. Most of these matters are conducted on an urgent basis.

Research and Legal Opinion and general legal advice

Our professional staff has extensive knowledge in research and legal opinion drafting. They continuously strive to increase their skills and knowledge by attending extra courses in order to render adequate services to our clients. CONSULTING Civil and Criminal Litigation including Evictions (Magistrates’ and High Courts)

Our members have gained extensive experience in regard to civil and criminal matters both in the Magistrates’ and the High Courts. They have acted for a number of people allegedly involved in criminal matters ranging from corruption, theft, fraud, possession of illegal substances, various traffic offences, culpable homicide etc. Our Messrs. Duma and Zitha have dealt with extensive civil matters between private individuals and corporate entities. They have dealt with matters involving the Road Accident Fund, the South African National Roads Agency, The South African Civil Aviation Authority, The National Home Builders Registration Council and various Municipalities. They have extensive experience both in the Magistrates’ and High Courts, but mostly litigate in the High Court. We are confident that our firm has the necessary experience to assist clients with any matter before the Magistrates’ or High Court. Our team of attorneys and candidate attorneys are extremely experienced in court appearances, drafting of pleadings, notices and other legal documents.

Our Messrs. Duma and Zitha as well as Ms. Swanepoel has experience in the drafting and vetting of various types of contracts as well as legal research and opinion drafting. We also served on the Corporate Panel of the Road Accident Fund.

Debt Collections

Having done legal collections for various corporate clients, the members of our firm have the necessary knowledge and expertise to assist clients when required with legal collections. We have a policy in regard to legal collections, which assures that a client at the end of the day will not get involved in costly legal excursions. In this regard we believe in proper management and communication between the attorney and the client in regard to processes to be instituted and the assessment of costs on an ongoing basis. Members of our practice have attended to collections on behalf of Servcon Housing Solutions, Telepassport (Pty) Ltd, Eskom Holding SOC Ltd and others. Our team is very knowledgeable on the National Credit Act and Consumer Protection Act.

Supply Chain Management and Procurement

Our Mr. Zitha and Mrs. Swanepoel have advised the City of Ekurhuleni on matters pertaining to their Supply Chain Management Policy, Legislation and Regulations surrounding Procurement as well the Municipal Finance Management Act and the Regulations thereto.

Victor Zitha

FOUNDING MEMBER

Victor Zitha qualified as an attorney in 2005. He holds an LLB degree and a certificate on the Road Traffic Act and Regulations. Mr Zitha has experience in the following areas of Law: General Civil and Corporate litigation both in the Magistrates’ and High Courts, General Commercial Litigation, Employment and Labour Law Litigation, Land Restitution Matters, Eviction Matters including ESTA and PIE, Land Claims Court Matters, Property Law Litigation and institution and defending various Applications in the High Court including rezoning and the contravention of.

Abednego Duma

FOUNDING MEMBER

Abednego Duma qualified as an attorney in 2003. He holds the degrees in B.Proc and LL.B. During his student years he was active in student affairs, such as the Student Representative Council and gained valuable experience in management, planning and leadership. Mr Duma has experience in civil and corporate litigation both in the Magistrates’ and High Courts, has handled matters in relation to Law of Delict, Employment Law, Personal Injury Law, Commercial Litigation, Family Law, Debt Collection and Environmental Law.

Kamogelo Malatji

ATTORNEY

Kamogelo Nthabiseng Malatji is a Bcom LLB graduate from the University of Johannesburg, she graduated in 2015 and 2018 respectively. After Graduation she served her articles at a firm that specialized in Conveyancing and later ceded her articles to a firm that deals with litigation. She is an Admitted Attorney with Right of Appearance in the High Court. She has experience in Civil Litigation and specializes in Personal injury and Third party claims.

Elmarie Borman

ATTORNEY

Elmarie studied law at the University of Pretoria from 1981-1985 and started work at Nelson Borman and Partners Randburg Branch on the 1st of April 1992. In 1994 she opened the Sandton Branch for the firm and thereafter she moved to the Blackheath Branch, where she is currently the head of Conveyancing for the Company and the Director who deals with HR and part of the management team. Elmarie has 29 years of experience in the legal field and has been involved in Conveyancing since 1992. She leads an experienced team that has been built through personal commitment and professional relationships with the firm's clients. Some of the people in our Conveyancing team have been working with Elmarie for 20 years.
